When do I need to re-register?
According to the provisions of the Enterprise Law 2020 and Decree 01/2021/ND-CP, enterprises have the right to temporarily suspend business but must notify in writing the time and duration of the suspension to the Business Registration Authority.
Re-registration is required in the following cases:
- According to Clause 2, Article 66 of Decree 01/2021/ND-CP, enterprises that continue to operate before the announced suspension period: This is the most common case where a business needs to notify the resumption of operations. The business must send the notification to the Business Registration Office no later than 15 days before resuming business before the announced date.
Important Note:
- In case the enterprise's temporary suspension period expires, according to Clause 1, Article 206 of the Enterprise Law 2020: If the enterprise has expired the period of temporary suspension of business according to the registered notice, the enterprise No need to notify to resume operations with the Department of Planning and Investment. At that time, the business's operating status will automatically change to "Active" on the National Business Registration Portal.
- Penalties for violations: If the enterprise resumes operations before the deadline without notifying the Business Registration Office as prescribed, the enterprise may be subject to an administrative fine of VND 10,000,000 to VND 15,000,000 according to Point b Clause 2 Article 44 - Decree 122/2021/ND-CP.

Or submit online at the National Business Registration Information Portal (mandatory form for businesses headquartered in Hanoi and Ho Chi Minh City).
