Conditions for applying for a swimming pool business license

Swimming pool business is a conditional business. To be granted a license, the facility must meet the following conditions:

Conditions of facilities and equipment

Pursuant to Circular 03/2018/TT-BVHTTDL, swimming pools must meet:

• Pool size: Minimum 6m x 12m or equivalent area.
• Bottom of tank: Has a uniform slope, no sharp bends, depth difference not exceeding 1m (pool ≥25m) or 0.5m (pool <25m).
• Wall, bottom of tank: Smooth surface, smooth, easy to clean.
• Starting platform: Only to be installed in swimming pools with a depth of not less than 1.35m.
• Changing room and toilet: Has flat, non-porous, non-slip floor.
• Foot wash area: Place in position before the practitioner enters the pool.
• Sound and lighting system: Ensure good operation, minimum brightness of 300 Lux at all locations above the pool water surface.
• Lifeline: Stretched to divide areas of the pool, ensuring safety.
• Rescue tools: At least 06 rescue poles (2.5m long, painted red-white), 06 lifebuoys placed on the pool wall in convenient positions, rescue chairs at least 1.5m high from the pool surface.
• Rules and signs: Place in easy-to-read, easy-to-observe locations, including practice hours, safety precautions, prohibited participants, and area signs (shallow water, deep water, no diving).
• Training density: Ensure at least 01 person/01m² in shallow water areas or 01 person/02m² in deep water areas.

Personnel conditions

• Rescue staff: Have a certificate of professional training in swimming and diving rescue issued by the General Department of Sports and Physical Training, Vietnam Aquatic Sports Association or the Department of Culture, Sports and Tourism. Must be on duty when the swimming pool is in operation, ensuring at least 200m² of swimming pool surface/01 employee, or 50 swimmers/01 employee at the same time when crowded.
• Healthcare staff: Have intermediate medical degree or higher, always on duty when the swimming pool is operating to provide timely emergency care.
• Swimming instructor (if swimming lessons are available): Must have a professional qualification in physical education, swimming and diving (or a certificate of professional training). Each teacher must not instruct more than 30 people (or 20 people for children under 10 years old) in one training session.
• Labor contract: For all professional staff.
• Medical Links: With the nearest medical facility.

Legal document requirements

Swimming pool business is a conditional business, so the owner must apply for 2 types of licenses:

• Business registration certificate: Can be a business household or enterprise, which must have industry code 9311 (Activities of sports facilities, details: Swimming pools).
