What is a gym business license?

A gym business license (bodybuilding and fitness) is a certificate of eligibility to operate a business issued by the provincial Department of Culture, Sports and Tourism to businesses or business households providing gym services. This license confirms that the facility has fully met the requirements on facilities, equipment, personnel and legal conditions as prescribed in the Law on Physical Training and Sports 2006 (amended in 2018), Decree 36/2019/ND-CP, Circular 10/2018/TT-BVHTTDL and related documents.

Appropriate business license

  • Establishment of individual business household: Suitable for small gyms (under 10 employees).
  • Establishment of business (company): Suitable for large-scale gyms, can open many branches or have a large number of employees.
  • Business license must have registration of sports business (specifically gym/fitness services).

Facilities

Pursuant to Article 3 of Circular 10/2018/TT-BVHTTDL, gyms must meet:

  • Acreage: The training room must have an area of at least 60 m², a distance from floor to ceiling of at least 2.8 m, and the training space must be airy.
  • Device distance: The distance between exercise equipment should be between 10cm and 30cm.
  • Light: 150 lux or more.
  • Sound system: In good working condition.
  • Amenities area: There are toilets, changing rooms, and places to store personal belongings for practitioners; there are first aid kits according to regulations of the Ministry of Health.
  • Rules: There are rules including training hours, participants, non-participants, and safety measures during training.
  • Fire prevention and fighting (PCCC): For gyms in commercial areas, apartments, entertainment areas, hotels, and resorts, valid fire safety records are required (fire safety inspection report, fire safety design approval certificate, fire safety minutes/decision).

Conditions on training equipment

Must have sufficient minimum equipment according to the prescribed list (e.g. treadmill, bicycle, weight rack, soft mat, dumbbells, etc.). Equipment must have a certificate of quality measurement standards, meet training needs, and not cause danger.

Conditions on professional personnel

Gym instructors (trainers) must meet the following conditions:

  • Be a coach or athlete suitable for registered sports activities with a level 2 or higher or equivalent.
  • Have a degree in physical education and sports from intermediate level or higher suitable for the registered sports business activities.
  • Receive professional sports training according to regulations of the Minister of Culture, Sports and Tourism.
  • Each trainer only guides a maximum of 30 students in one session.
