A license to establish a foreign language center (also known as a Certificate of Training and Education Activities) is a legal document issued by the Department of Education and Training, allowing qualified organizations and individuals to operate in the field of foreign language teaching.

  • Legality: Foreign language center business is a conditional business. Operating without a license is a violation of the law and may be subject to an administrative fine of VND 20,000,000 to VND 40,000,000 according to Clause 2, Article 5 of Decree 04/2021/ND-CP, and may also be subject to suspension of operations.
  • Protecting students' rights: The license proves that the center has met all the requirements regarding facilities, teaching staff, and training programs, ensuring teaching quality and the legal rights of learners.

Conditions for applying for a license to establish a foreign language center

Pursuant to Circular 21/2018/TT-BGDDT and related legal regulations, to be granted a license, a foreign language center must meet the following conditions:

Subject conditions

  • Individuals or companies registered for foreign language training profession.
  • Completed the registration procedure for establishing a business/business household at the Department of Planning and Investment with the appropriate industry code (usually 8559 - Other education not classified elsewhere).

Conditions of facilities and equipment

  • Classroom: Ensure minimum usable area of 1.5m²/student, adequate lighting, fully equipped with teaching equipment such as boards, projectors, tables and chairs...
  • Functional rooms: There are enough classrooms (at least 3) and functional rooms (meeting rooms, library, administrative area, offices, restrooms...) to meet the operational requirements and scale of the center.
  • Legal location documents: Houses and land must have legal owners or a lease contract (if rented, approval from the superior management agency is required if the house belongs to an agency/unit/school). The address on the business license must be consistent with the house and land documents.
  • Fire prevention plan: Have fire prevention and fighting equipment according to regulations, have fire prevention and fighting inspection records, develop fire prevention and fighting and escape plans, and rescue plans approved by the fire prevention and fighting police agency, have fire prevention and fighting regulations and a list of fire prevention and fighting teams.
  • Other utilities: There is a parking lot and parking plan, a safe and secure educational environment.

Personnel conditions

  • Center Director:
    • Good personality, management ability.
    • Graduated from university majoring in foreign languages, or graduated from university of other majors with a minimum foreign language certificate of level 3 according to the 6-level foreign language proficiency framework for Vietnam (equivalent to European B1, IELTS 5.0, TOEIC 450, Japanese N4, Korean TOPIK 3, Chinese HSK 3).
    • Have worked in the education industry for at least 3 years (management experience).
  • Teaching staff:
    • Have a college degree in foreign language education or higher, or a college/university degree majoring in foreign languages with a certificate of pedagogical skills.
    • Ensure maximum ratio of 25 students/teacher.
    • Degrees and certificates must be appropriate to the type of foreign language the center registers to teach.
  • Staff: Ensure adequate staff for administrative and academic work (for example, accounting staff with intermediate or higher qualifications).

Curriculum requirements

  • The curriculum, textbooks, and teaching materials must be suitable to the learners' conditions, local development, and not contrary to the regulations of the Ministry of Education and Training.
  • It is possible to use documents issued by the Ministry of Education and Training, self-compiled, or use documents from domestic and international educational organizations based on learners' needs and the center's ability to respond.
